The Basics of Disability Lawyer Fees

One of the most common concerns for people applying for Social Security Disability (SSD) benefits is: “How much will it cost me to hire a lawyer?” The good news is that you never pay anything out of pocket to hire a disability attorney.


Social Security disability lawyers work on a contingency fee basis. That means:

  • You only pay if you win your case.
  • The attorney’s fee is taken directly from your back pay award (the lump sum SSA owes you when your case is approved).
  • If you don’t win, you don’t owe a fee.


The Federal Fee Cap

The Social Security Administration regulates attorney fees, so there are no surprises. In 2025, the rule is:

  • Attorneys can charge 25% of your past-due benefits,
  • Capped at $9,200 maximum.


This cap means no lawyer can charge you more than $9,200 for representation at the initial, reconsideration, or hearing level.


Example of How It Works

  • Let’s say SSA approves your claim with $20,000 in back pay.
  • The attorney’s fee would be 25% = $5,000.
  • You would receive $15,000 in back pay, plus your monthly disability checks going forward.


If your back pay is very high, the most an attorney can take is $9,200—even if 25% would have been more.


What About Ongoing Monthly Benefits?

Attorney fees are only taken from back pay, not your future monthly checks. Your ongoing SSDI or SSI benefits are 100% yours.
